Introduction

Thank you for using our services, which we provide following the idea of providing convenient access to audio content available to the public on the Internet, in particular to Internet radio stations.

Replaio Services

Replaio provides individual users for personal and non-commercial use only with the Replaio Browser service that is available through the Replaio Services, including the Replaio Radio app.

We also work with owners of publicly available audio content on the Internet, supplying to them Replaio Search services and tools. We also provide consulting services for them.

Replaio Services Provider

The entity providing Replaio Services is Replaio sp. z o.o. registered in Krosno (Poland), Tysiąclecia 14a, NIP 6842650730, REGON number 381340090 entered into the National Court Register by the District Court in Rzeszów, 12th Commercial Division of the National Court Register, under KRS number 0000749616 (hereinafter referred to as Replaio).

Replaio is a brand of Replaio sp. z o.o. All other names, trade names, brands and trademarks that may appear in the Replaio application, on the Google Play website and on other Replaio websites are the property of their respective owners and are used only for informational and identification purposes. Replaio and the services we provide are in no way affiliated with these entities.

Replaio Services are provided and operated by Replaio sp. z o.o. Replaio does not guarantee that content available through Replaio Services is appropriate, lawful or available for use in locations other than Poland. Users who want to access or use the Replaio Services in locations other than Poland do so at their own risk. Access to the Services from locations (jurisdictions) where the content or functionality of the Replaio Services is illegal is prohibited.

Applicable Conditions

The use of our services is subject to these terms and conditions named as the "Agreement". We kindly ask you to carefully read these terms, our Privacy Policy and any other terms and conditions specified in this document. If you do not understand the Agreement or accept any part of it, you may not use the Replaio Services.

The content of this Agreement applies to all users, including users representing content owners using the Replaio Services.

We will treat the commencement of use of the Replaio Services as acceptance of all provisions in this document and in our Privacy Policy.

This agreement to provide Replaio Services is in effect and will remain in effect until terminated by either party at any time for any reason.

Who can use Replaio Services?

Individual users

Age requirements

The user may use the Replaio Services if:

  • has reached the age of majority specified in the country of origin,
  • is over 13 years old and has the consent of the parent or legal guardian.

Parent or guardian consent

If you are between 13 and 18 years of age, you must have permission from your parent or legal guardian to use the Replaio Services. The parent or legal guardian should read and accept this Agreement.

Parents or legal guardians of a User aged 13-18, by agreeing to use our Services, are subject to the provisions of this Agreement and are responsible for the minor User's activity on the Replaio Services.

Audio content owners

Replaio Services are available to companies and organizations, including users representing the owners of the content, including audio content. If you use our services on behalf of a company or organization, you acknowledge that you are authorized to represent that entity, and that entity fully accepts this Agreement.

Replaio Services

Definitions

Public Audio URL - a hyperlink, a reference to audio content (including an Internet radio station) publicly available on the Internet. The Audio URL is always under the full and exclusive control of its owner.

Public URL address - a hyperlink, i.e. a reference to a website publicly available on the Internet. The URL is always under the full and exclusive control of its owner.

Subject of the Services

The provision of Replaio Services consists in providing users with tools and applications that are based on the following services:

  1. Replaio Browser - a free web browser with a built-in audio content player, which allows, among others, convenient listening to Internet radio stations publicly available on the Internet.

  2. Replaio Search - a content search engine on the public internet, with particular emphasis on URLs and Audio URLs leading to audio content, including internet radio stations.

  3. Replaio Console - a service for users - owners of audio content, allowing to add and manage URLs and Audio URLs.

Replaio Browser

Replaio Browser is a specialized web browser with a built-in, advanced audio content player. It allows searching, viewing and playing content, publicly available on the Internet, to which URLs and Audio URLs link, on the user's device.

  1. Replaio Browser works based on the same mechanisms used in popular, commonly available browsers and search engines on the market.
  2. Replaio Browser allows users to search for URLs and Audio URLs that link to audio content, including streams of Internet radio stations.
  3. Replaio Browser allows users to reach publicly available content on the Internet and add their URL to the favourites list. This allows reaching quickly and conveniently the favourite content.
  4. Replaio Radio users have the option to submit a web URL and Audio URL by themselves (as with other web browsers), and then view the content of the website and listen to the audio content available at the entered address.
  5. The specialized Replaio Browser also allows using the built-in, advanced audio content player.
  6. Replaio Browser which works like a typical web browser allows playing audio content. Additional built-in features facilitate the reception of content, e.g. by improving the sound quality through the equalizer integrated with Replaio.
  7. Playing audio content, including Internet radio stations available to the public on the Internet at specific Audio URLs, takes place by connecting the user's device directly to the servers (services) used by the owners of the audio content.
  8. The Replaio Radio browser, at the user's request, establishes a connection between the user's device and the audio content available at specific URLs or Audio URLs on the public internet.
  9. The website address is always displayed (as with any other typical web browser) in the bar at the top of the screen, after maximizing the browser window.
  10. Replaio does not guarantee to display and listen to all audio content the publicly shared URLs are linked to.
  11. If the URL or Audio URL is available in your country, Replaio Browser, like other web browsers, will display and play content that is published there.

Replaio Search

Replaio Search is a public URL and Audio URL search engine with a focus on URLs and Audio URLs leading to publicly available audio content, including internet radio. It allows users to search for URLs and Audio URLs by query by entering keywords.

The search results in Replaio Search are given in 3 steps.

  1. Scanning - obtaining information on public URLs and Audio URLs available on the Internet.
  2. Indexing - analysis of URLs and Audio URLs obtained from broadcasters and as a result of the operation of Replaio robots, in terms of public availability of audio content, including Internet radio stations. 3 Displaying of results - finding information in the Replaio index and present the results to the users.

Public URL addresses

  1. All URLs and Audio URLs available in Replaio Search are publicly available on the internet.
  2. Replaio is not the sender, it does not transmit, and it does not act as an intermediary in the transmission of audio. It does not retransmit or interfere with the audio stream available at certain public URLs or Audio URLs.
  3. Replaio Browser connects the user's device directly to the server used by the owner of the URL or Audio URL for the sole purpose of displaying or playing content from a source on the Internet located at a specified public URL or Audio URL.
  4. Replaio in no way changes the content available at the specified URLs and Audio URLs.
  5. Replaio does not breach access restriction protections in any way when used by URL and Audio URL owners.
  6. To ensure free access to public content, we remove URLs or Audio URLs from Replaio Search only in strictly defined circumstances, e.g. at the request of their owners.
  7. All intellectual property rights in the content of URLs and Audio URLs are the responsibility of the owners of the respective URLs and Audio URLs. Replaio is not responsible for the legality of the content accessible at public URLs and Audio URLs.
  8. Replaio users are always the recipients as they were in the original sharing. All URLs and Audio URLs indexed by Replaio Search are publicly available on the internet. The owners of the pages on which they are published do not limit access to them in any way - all Internet users have access to them. The solutions used by Replaio (including embedding) do not make URLs and Audio URLs available to new audiences (new users).
  9. Replaio does not index URLs and Audio URLs that have security features that prevent content from being played directly from a specific URL or Audio URL (e.g., a temporary access key).

Adding URLs and Audio URLs to Replaio Search

Addresses linking to audio content available on Replaio services are added to Replaio Search by:

  1. Content owners (accessed by URLs and Audio URLs) and their representatives via Replaio Console.
  2. Replaio scanning (indexing) robots.

Adding addresses by senders, including radio stations

  1. Any owner of audio content, including a radio station, can submit their URLs and Audio URLs to Replaio Search.
  2. The presence of URLs and Audio URLs in Replaio Search is free.
  3. Applications can only be made through the Replaio Console available at https://repla.io/add-url.
  4. The person who created the account is responsible for the data sent via Replaio Console.
  5. By submitting data to Replaio Search, the person acting on behalf of the sender declares that all data, including contact details, are true.
  6. Submitting data to Replaio Search via the sender's panel is equal to the sender's consent to the processing and sharing of this data in Replaio Services.
  7. In particular, the user consents to Replaio to provide Audio URLs and logos representing the sender's brand.
  8. The user declares that has full right to the content broadcast and is fully responsible for it.
  9. The user declares that the provision of the Audio URL does not violate applicable law, in particular copyright.
  10. The user declares that the obligations imposed by the copyright law in connection with the broadcasting of the audio content are on the represented sender's side and that the sender is fully responsible for them.
  11. In addition, the user on behalf of the sender declares that:
    • owns or has the right to publish/broadcast content which the shared URLs and Audio URLs link to,
    • has all the necessary rights, licenses, authorizations, permission from third parties whose content provides via URLs and Audio URLs,
    • is fully responsible for compliance with the terms of the licenses, authorizations and approvals concluded with third parties regarding the content available at URLs and Audio URLs,
    • is fully responsible for the performance of any financial settlements due to royalties and fees to third parties resulting from the concluded licenses, authorizations or authorizations related to copyright.
  12. The user, on behalf of the broadcaster, declares his full responsibility for the distribution and for the possible need to restrict the distribution of his URLs and Audio URLs within certain territories. This means that the broadcaster, by making the content available in certain territories, obtained all the necessary rights to do so, and in the absence of such rights, he must implement all the necessary solutions to block distribution in locations where the content should not or cannot be available.
  13. The user, on behalf of the sender, declares bearing full legal responsibility for the publication, in any form, of advertising within the content available at URLs and audio URLs.
  14. The user declares to comply with the laws governing the publication of information and advertisements, including the recommendations of the FTC.
  15. By publishing content, including URLs, Audio URLs, names, descriptions, graphic symbols, Replaio, the user grants Replaio a non-exclusive, free, worldwide license to reproduce, share, display, modify, translate, create derivative works, distribute via any medium, method or technology already known or introduced in the future for any purpose, including promotion of Replaio's services.
  16. If the user does not want Replaio to use the content of the sender represented, it should not be published through any of Replaio's services.
  17. The user, by publishing data using Replaio's services, indemnifies Replaio from liability for all possible damages and expenses (including costs and attorney's fees) related to the breach by the sender represented, including the rights of third parties.
  18. It is not allowed to add URLs and Audio URLs to Replaio Search leading to prohibited content which:
    • incites hatred and discrimination against specific people or groups,
    • is intended to harass, intimidate or bully a specific person or group of people,
    • contains threats or incite physical or mental harm to oneself or to others,
    • contains false statements and may adversely affect participation in the electoral or democratic process and public trust in these matters,
    • misleads users with falsified information related to politics, social issues or matters of public importance,
    • contains texts, images, sounds of a clear sexual or pornographic nature, represent sexual activities; can be interpreted as promoting the sexual act for reward, promoting the sexual exploitation of minors,
    • contains lewd or vulgar content - including, but not limited to, profanity, insults, curses,
    • promotes terrorism,
    • presents information in a way that does not show adequate social sensitivity,
    • promote the sale of explosives, firearms, ammunition or firearm accessories,
    • promotes the sale of marijuana and marijuana-containing products,
    • promotes the sale of products derived from endangered animal species,
    • promotes the sale of tobacco and encourage the illegal or improper use of alcohol or tobacco.
  19. The user on behalf of the sender declares that content linked to the URLs provided in Replaio Console does not contain the prohibited content listed in the above point.
  20. On behalf of the broadcaster, the user acknowledges and accepts that Replaio has the right to display advertisements in the application - graphic banners and video advertisements. At the same time, Replaio ensures that each of these forms of advertising will not violate the continuity of the audio content to which the Audio URLs provided by the broadcasters link.

Adding URLs and audio URLs to Replaio Search by scanning (indexing) robots

In order to share in Replaio Search the URLs and Audio URLs linking to content publicly available on the Internet, we also use scanning robots.

  1. The robots work by visiting publicly available websites. They scan them just like search engines and analyze the content for publicly shared URLs and Audio URLs.
  2. Scanning robots open links just like users browsing the web. They go from link to link and send information about publicly available URLs and audio URLs to Replaio Search.
  3. Scanning robots also analyze the content of "robots.txt" files, which are used to determine how the content on the visited website should be treated.
  4. The website owner, by appropriate entries in the "robots.txt" file, can completely block the indexing of the websites by the robot, thus excluding the sharing of links to content, including audio content in Replaio Services.

We respect owners' decisions to share URLs or Audio URLs

Replaio respects intellectual property rights and does not tolerate any kind of infringement. We have developed a policy that includes a breach reporting procedure.

Management of The URL and Audio URL availability by Replaio Search Tool

  1. Replaio respects the decisions of owners of certain URLs or Audio URLs regarding their presence in Replaio Search.
  2. We have developed the Replaio Search Tool system that allows audio content owners to manage URL or Audio URL accessibility in Replaio Search.
  3. Replaio Search Tool allows URL or Audio URL owners to fully decide on the presence of their URLs in Replaio Search, including (at any time) revoking consent to their presence in Replaio Search, blocking the possibility of adding or modifying by unauthorized users.
  4. Replaio Search is a search engine only for publicly available, unsecured URLs and Audio URLs. Each of the owners of such addresses can prevent them from being added to search engines, including Replaio Search. This can be done using commonly available solutions, incl. based on entries in robots.txt and .htaccess files or other (e.g. configuration of the validity time of a specific address).
  5. These are generally accepted, cost-free and easy to implement mechanisms, interpreted by all resource indexing services on the Internet. Information on this type of security is publicly available. You can also find more information later in this document.
  6. Each owner of URLs and Audio URLs can apply security measures (e.g. by using the so-called temporary access key) against their playback in external browsers. These types of security measures are commonly used by entities that do not allow URLs and Audio URLs to be made publicly available.
  7. The use of such security is clear information that such addresses will not be indexed by Replaio Search and will not be available in the search results for Replaio Radio users.

Blocking URLs and Audio URLs with commonly available tools and technologies

  1. The Replaio viewer only establishes a direct link between the user's device and the source available at the URL or Audio URL, therefore the transmission can be completely controlled and managed by the owner of the audio content.
  2. Each of the audio content owners can independently block access to their audio content by changing the status from a publicly available audio URL to authenticated. Content protected in this way will immediately cease to be available on Replaio services. No additional action by Replaio is required.
  3. (Alternative option) Removal of addresses from Replaio Search can also be proceeded at the express request by contacting us by e-mail to the address support@repla.io. URLs and Audio URLs submitted by their owners will be added to the list of blocked addresses. From now on, they will not be available in Replaio Search results, they cannot be added to Replaio Search again and will not be indexed by Replaio robots.
  4. (Alternative option) Each of the audio content owners can block access to their content by making appropriate configuration records on their servers - standard robots blocking mechanisms by configuring the robots.txt file:

Such records will be clearly interpreted as a refusal to index and share URLs and Audio URLs on Replaio Radio.

Audio content in Replaio Radio

  1. Replaio Radio does not transmit, broadcast, rebroadcast, retransmit, distribute or store any audio content.
  2. Replaio is not a hosting service and does not store any audio or video files.
  3. Replaio Search only indexes URLs and audio URLs to publicly available content, including audio content.
  4. Replaio in no way breaches any security measures that can be used by owners of audio content to prevent playback on external players and blocked locations.

Audio Content Copyright

  1. Replaio has no technical or legal means to verify or adjudicate to whom the copyright of the content available on the publicly available Internet URL or Audio URL belongs.
  2. It is forbidden to use our services to infringe copyright. We do not agree to add URLs or Audio URLs to Replaio Search for content that infringes copyright, even if it is publicly available on the Internet.
  3. Replaio displays and plays only content that is publicly available on the internet. Third parties, i.e. the owners of URLs or Audio URLs, are responsible for the content, and in particular for the resulting infringement of copyright, industrial property rights and personal rights.
  4. The obligations imposed by the copyright law (e.g. geo-blocking) are the responsibility of the owners of the Audio URL addresses.

Graphic identification

  1. For graphical identification purposes in Replaio Search, the search results show publicly available identification marks (logos) of the content owners by using public URLs.
  2. Displaying graphic symbols linked to publicly available URLs is performed similarly to commonly available search engines.
  3. URLs leading to identification marks are addresses to image files that are:
    • website logo (e.g. ico, og:image),
    • an avatar or profile photo shared on a public profile of popular social networking sites (e.g. Facebook, Twitter, Instagram).
  4. Any owner of the audio content can provide their own identification marks for inclusion in Replaio Search using the form or by sending a message to the e-mail address: support@repla.io.
  5. Indexing and displaying identification characters are performed with the use of standard cache mechanisms - similar to popular web browsers.
  6. Replaio Browser does not provide an option that allows users to download and share identification marks.
  7. Graphic images shown in Replaio Search search results may be copyrighted.
  8. The use by Replaio Radio users of search results containing identifying marks may in no way infringe the law.
  9. Replaio does not grant users any rights with regard to the graphic identification marks of third parties.

Reporting violations

  1. Replaio respects the law, including intellectual property rights and rights related to the publication of information. Replaio does not tolerate any kind of violation of the law.
  2. The Replaio user has the option to report any infringement of the law, including intellectual property rights, and the presentation of prohibited content by contacting us at the e-mail address: support@repla.io.
  3. Another form of reporting a violation is to fill in and send the form for reporting a violation / disabling access to content: https://repla.io/report.
  4. Each notification of a violation may have legal consequences. Please carefully analyze the violation before reporting.
  5. If Replaio is notified that any Content accessed via the URL and audio URL infringes the copyright or other law, Replaio may remove these URLs from the Replaio Services or take other steps it deems appropriate without prior notice.
  6. In the event that users find repeated violations by adding URLs and audio URLs to content that violates applicable law, Replaio may delete the account and block access to the services.

Other content - advertising

  1. Replaio may display advertisements for goods and services from entities unrelated to Replaio.
  2. Replaio does not in any way represent these entities.
  3. Thanks to advertising, Replaio remains free for its users. Furthermore, it allows us to constantly develop the application, take care of its quality and proper operation on various devices and different versions of systems.
  4. We also provide a Premium version without in-app banner ads, but the basic Replaio feature - playing content available at public URLs or Audio URLs is and will always be free.
  5. Replaio has no influence on audio advertisements broadcast by radio broadcasters. It does not limit them in any way. Their presence is not dependent on the fees for Premium services in Replaio.
  6. By using Replaio, the user acknowledges that Replaio is not responsible for any loss or damage arising from the relationship between you and a third party.

Liability for content - disclaimer

  1. Replaio Browser allows users to access public content, including audio content, available at specific URLs and audio URLs belonging to third parties.
  2. The user acknowledges and accepts that the owners are responsible for all information, data, content, including audio, graphics and video.
  3. Replaio does not monitor, control, approve, or take any editorial or programmatic control over the content available at public URLs and Audio URLs belonging to third parties.
  4. Third parties, i.e. the owners of URL and Audio URL addresses, are responsible for the infringement of copyright, industrial property rights and personal rights.
  5. As a Replaio user you acknowledge and agree that while using Replaio, you may be exposed to objectionable content, including unreliable, untrue, offensive and indecent content.
  6. Replaio is not responsible for the content of third parties, in particular for the presentation of illegal content, including those described in the section "Adding URLs and Audio URLs to Replaio Search".
  7. Replaio does not in any way support, endorse, or finance the content, including audio content, available at specific URLs and audio URLs belonging to third parties.
  8. Search results in Replaio Search may contain hyperlinks to other websites that are not owned or controlled by Replaio. Replaio has no control over the content, privacy policies, or practices of third party websites. Replaio is not responsible for them.
  9. As a user of Replaio, you acknowledge and agree that Replaio is not responsible for the availability of external websites or resources and is not responsible for any advertising, products or other material available through or on such websites.
  10. By using the Replaio Services, you acknowledge and agree that Replaio is not responsible for any loss or damage you may incur as a result of the availability of external sites or resources, or as a result of your reliance on the completeness, accuracy of the information, or the existence of any advertising, products or other material on such sites or resources.
  11. To the extent permitted by applicable law, Replaio shall not be liable to users for losses or damages incurred as a result of:
    • users entering into any contact with an advertiser or entering into a transaction with an advertiser whose advertisements are displayed as part of the Replaio Services,
    • deletion, damage or non-retention of content and data processed as part of your use of Replaio Services.

Anonymous use and user account

  1. As a user, you can use the application completely anonymously. The use of key functions does not require an account.
  2. Not having a user account in no way limits the main function of Replaio Radio - access to content, including audio content, available to the public on the Internet.
  3. A user account is only necessary if the user wants to use additional features of the application - cloud storage and synchronization of favourite URLs and Audio URLs between devices.
  4. Creating an account or using certain features in Replaio requires the user to provide necessary data, including an e-mail address.
  5. By providing your data, including your e-mail address, you consent to the collection and use of this data in accordance with the Privacy Policy available at: https://legal.repla.io/privacy
  6. To ensure the security of Replaio account keeping the password confidential is highly recommended. It is not advised to use the Replaio account password with third-party services and applications.

Free version and Premium version of Replaio Radio

  1. The basic features of Replaio Radio are free of charge.
  2. The fee applies to the use of additional options and features available in the Premium version.
  3. The Premium version payment disables advertising banners in the application and allows using additional options and features in the application such as widgets, shortcuts to favourite stations, additional features in the notification.
  4. The fee is charged once and gives you indefinite access to the Premium version.
  5. Payments are handled only by Google Play.
  6. The Premium version payment is also a form of user support for the maintenance and development of the application.
  7. Replaio reserves the right to modify the options and features included in the Premium version, change its price, including organizing special promotional campaigns lowering the standard price.
  8. The payment for the Premium version is assigned to the Google Play account. The user can use Replaio Premium on multiple devices on the condition that the same Google Play account is used on each of these devices.
  9. Premium purchases that are made through in-app purchases are not available in the Google Play family library. This is due to the limitation of the service managed by Google.
  10. The fee for the Premium version does not include an RTV subscription and does not affect audio advertisements broadcast by radio stations before the start of playback or during the broadcast.
  11. Using Replaio may be associated with fees for internet access and data transmission charged by external companies - Internet or mobile operators. The payment of these fees is the responsibility of the User.

Privacy, user data

  1. Using the Replaio Radio application does not require the user to provide personal data.
  2. In our Privacy Policy, we explain how we treat the data and how we protect privacy when using Replaio Services.
  3. Replaio undertakes that during the processing of personal data in connection with the provision of Replaio Services and after termination, it will comply with the relevant and applicable provisions on the protection of personal data, including in accordance with the General Regulation on the Protection of Personal Data (Regulation of the European Parliament and of the Council ( EU) 2016/679 of 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC GDPR.
  4. Replaio undertakes to exercise due diligence, to the extent justified by technical or economic reasons, when securing data sets.

Software in the Service

  1. To provide the Services, Replaio provides users with the Replaio Radio application.
  2. Replaio allows access to Replaio Services only through applications legally downloaded through services provided by official resellers and suppliers.
  3. Replaio Radio sellers and suppliers are:

  1. Replaio is not responsible for the operation of applications downloaded and installed from outside the sources indicated in point 3.
  2. Installing applications from outside the sources indicated in point 3 may involve the risk of the application malfunctioning, or even the device may be infected with third party malware.
  3. As a user of Replaio Services, you grant permission to automatically update the software on your device when a new version or feature is available, depending on your device settings.
  4. Replaio provides a personal, worldwide, free, non-transferable and non-exclusive license to use the provided software as part of the Services provided.
  5. This license is for the sole purpose of enabling users to use the Services provided by Replaio as permitted by these Terms.
  6. The user is not allowed to modify, distribute, sell, or lease any part of the Replaio software, and reverse engineer or attempt to extract the source code.
  7. The Replaio software contains features that may use integration with third-party services.
  8. Third-party services are ruled by their own terms or privacy policies, so their use is subject to these terms and privacy policies.
  9. By using Replaio Services, you acknowledge and agree that Replaio Radio does not support third-party services or transactions that you may enter into with the provider of such services and is not responsible for them.

Use of the Services, requirements, restrictions

Access to the Services provided by Replaio and their use in the form provided is possible only on the condition that the provisions of these terms and applicable law are complied with.

Replaio Radio allows access to content available at public URLs and audio URLs only for private, non-commercial purposes.

Under this agreement, Replaio only grants Users the right to use the Replaio Services to search and play content, including audio content, for private (non-commercial) use. Further use of the Replaio Services, in particular reproduction, distribution, disclosure to the public and decompilation, is prohibited.

The user is responsible for all forms of use related to the playback of audio content that goes beyond mere playback.

All further rights to the elements and content of the Replaio Services are reserved and require a separate license from Replaio and / or other rights holders. This applies in particular to the local storage, reproduction, distribution and public making available of any element of the Services or any materials derived from it.

Requirements

  1. Use of Replaio Services may only take place with the use of final Devices with the parameters and properties specified on the Replaio Radio application website on Google Play.
  2. Use of Replaio services requires access to the Internet.
  3. The quality of the Services may depend on the parameters of internet connections, their quality and the configuration of final devices used by the user.
  4. The user undertakes to use any information obtained in the course of using the Replaio Services in good faith and refrain from using this information to harm third parties.
  5. The user undertakes to indemnify Replaio from any third party claims that are brought against Replaio due to the User's infringement of the rights of third parties. This also includes reasonable costs for legal representation. Replaio's further legal claims remain unaffected.
  6. The user using Replaio Services while driving a car or another vehicle undertakes to maintain such a level of caution that will provide himself and all road users with the highest level of safety. The user undertakes to comply with the road traffic regulations regarding the use of electronic devices while driving a car or other vehicle.
  7. The user undertakes to read and follow the manufacturer's recommendations regarding the use of the device used while driving.

The following actions are not allowed:

  1. Copying, redistributing, duplicating, copying to hard drive, recording, transmitting, publicly play or broadcasting any portion of the content, including audio content obtained while using Replaio services.
  2. Use of Replaio Radio to import or copy any local files that the user is not authorized to import or copy in this way.
  3. Circumventing or blocking ads.
  4. Use of Replaio Radio's information systems to commit a prohibited act.
  5. Misusing of the procedures established for submitting claims, including by submitting unsubstantiated or false information.
  6. Use of the Replaio Services to display or listen to audio content for a purpose other than your personal or non-commercial use, for example, you may not broadcast audio content to the public using the Replaio Services.
  7. Use of the Replaio Services to distribute illegal content, including audio content.

As a user of the Replaio Services, you agree that the only remedy in the event of problems or dissatisfaction with the Replaio Services is to uninstall the Replaio application and cease using the tools provided by the Replaio Services.

Guarantee, troubleshooting, complaints

Replaio was created and operated by a small group of people. We love radio, we are fans of good music and new technologies. We try to do everything with due diligence and with our skills. Bearing in mind the technological complexity of the matter in which we operate, we are aware that not always and everywhere our services fully meet the expectations of our users. Therefore, we kindly ask for your understanding and we count on openness in case of problems and difficulties. We are always open to questions and ready for cooperation and dialogue.

  1. By using Replaio Services, you have the right to make a complaint in matters related to the functioning of the Replaio Radio Services.
  2. All complaints should be submitted electronically to the following address: support@repla.io.
  3. Replaio will consider the complaint within 14 days of its receipt.
  4. A response to the complaint will be sent to the address provided by the User in the complaint.
  5. Replaio reserves the right to extend the period specified in point 3 above - by no more than 10 days - if the examination of the complaint requires unusual, special actions and arrangements or if it encounters obstacles beyond the control of Replaio. In addition, we reserve that considering the complaint may require obtaining additional explanations from the User - the time of providing explanations by the User extends the period of examining the complaint each time.

Limitation of Liability

To the extent permitted by applicable law, Replaio is not responsible for:

  1. Any loss or damage resulting from breach of the Agreement by Replaio, which could not be foreseen during the conclusion of the Agreement.
  2. Loss and damage suffered by the user as a result of changes that may be made to the Replaio Services, the temporary or permanent cessation of the Services, or the resignation from Replaio Radio components and functions.
  3. Losses and damages suffered by the user as a result of using Replaio Services while driving, and in particular if the use of the phone while driving is inconsistent with road traffic regulations.

If the User uses the Service to run business, to the extent permitted by law, Replaio is not responsible for lost profits, revenues or data, loss of business opportunity or anticipated savings, indirect or consequential losses.

Changes in the Replaio Services

  1. Replaio may, at its sole discretion and at any time, modify, add to, or remove content and functionality provided through the Replaio Services without notice.
  2. Replaio may terminate or discontinue support for any version of the application, whether it was offered for free or for a fee.
  3. Replaio also reserves the right to discontinue some or all of the features on the Replaio Services at any time and at its sole discretion, including providing software updates and cross-device or platform support.
  4. As a user of Replaio Services, you acknowledge and agree that Replaio will not be liable to users or third parties for any modification, suspension or discontinuation of the Replaio Services.
  5. No refunds will be given in the event of termination or discontinuation of any paid Replaio Service.

Information about the Terms of Use and Agreement

Changing the Terms and the Agreement

  1. We may modify these Terms to reflect changes to our Services in the event of changes in law, regulation or security.
  2. Replaio will notify users of our services at the right time about modifications to the provisions of the Terms of Use.
  3. Changes to new features introduced to the Replaio Services or made for legal reasons take effect immediately.
  4. When making material changes to these terms, Replaio will notify users, e.g. by displaying a prominent notice on the Replaio Services or by sending an e-mail.
  5. Any changes to the Terms become effective upon posting.
  6. After the information about changes to the Terms is published, the User is obliged to immediately familiarize himself with the changes.
  7. If you do not accept the modified Terms, you should refrain from using the Replaio Services.
  8. If you continue to use the Replaio Services after notification of the changes, we will treat this as your acceptance of the new Terms.

Other provisions

In case of the invalidity of any provision in these Terms, the invalid provision will be replaced with the provision that comes closest to the intended legal purpose of the invalid provision.

The courts in Poland have exclusive jurisdiction to settle any dispute that may arise out of or in connection with these Terms of Use.

These Terms of Use shall be governed by and construed in accordance with Polish law, excluding its conflict of law rules.

Failure to comply with the conditions

If you do not comply with these Terms and Replaio does not take appropriate action immediately, this does not mean that we are waiving any rights we may have, such as the right to take action in the future.
